Tiene 18 a\u00f1os, pero se cas\u00f3 hace poco y tiene un hijo.<\/strong><\/p>\n<p>Debido a que el difunto estaba casado y ten\u00eda un hijo, seg\u00fan la ley de Washington, ese hijo y su c\u00f3nyuge son beneficiarios legales y podr\u00e1n presentar una demanda por muerte por negligencia. Una vez que el tribunal designe a ese representante personal, se podr\u00e1 presentar una demanda en nombre de los dos beneficiarios legales que mencionamos.<\/p>\n<p>Si hay m\u00e1s de un beneficiario legal que tiene derecho a recuperar dinero, entonces un tribunal tendr\u00e1 que realizar lo que se llama una <em>audiencia de razonabilidad<\/em> para determinar qu\u00e9 beneficiario legal recibe qu\u00e9 parte del monto de dinero recuperado. El monto recuperado en una demanda por muerte por negligencia est\u00e1 destinado a cubrir cosas como los salarios futuros perdidos del fallecido, adem\u00e1s de la p\u00e9rdida de la relaci\u00f3n con esa persona. Obviamente, puede ser una cantidad sustancial porque no hay forma de reemplazar a un ser querido.<\/p>\n<h3>Entonces \u00bfqui\u00e9n puede presentar una reclamaci\u00f3n?<\/h3>\n<p>En teor\u00eda, cada beneficiario legal tiene una reclamaci\u00f3n independiente por la p\u00e9rdida de su relaci\u00f3n. Por lo tanto, en este ejemplo, el c\u00f3nyuge tendr\u00eda una reclamaci\u00f3n por la p\u00e9rdida de la relaci\u00f3n marido\/mujer, y el hijo tendr\u00eda una reclamaci\u00f3n independiente por la p\u00e9rdida de la relaci\u00f3n padre\/hijo.
