The only hard deadline to file your claim is the Statute Of Limitations (SOL), a law that sets a strict time limit for filing your case to recover damages.

In Washington state, the statute of limitations is 3 years from the date of your accident or injury.

Revised Code Of Washington (RCW) 4.16.080 “(2) An action for taking, detaining, or injuring personal property, including an action for the specific recovery thereof, or for any other injury to the person or rights of another not hereinafter enumerated;”

However, there are hundreds of soft deadlines that can negatively impact your case if not met on time, so waiting until close to the statute of limitation can be a bad strategy. In fact, it is important to hire legal representation as soon as possible.

What happens if you reach the time limits?

If you do not file your claim within the time limit, your case will most likely be dismissed, preventing you from recovering any compensation for your injuries.

What is your best strategy?

It makes sense from the injured person perspective to get a lawyer involved as early as possible for many reasons:

  1. Get the most work from your attorney for the same amount of money
When you are paying your lawyer on a “Contingency Fees”, meaning your lawyer get a percentage on whatever he will be able to recover for you, that amount is not going to change regardless of how much work the attorney will get done for you.
  2. Be protected from making mistakes that will hurt your case
Our attorneys have years of experience and have helped thousands of people on their injury claims. We know the things that should be done, and more importantly, those that should not be done because they would hurt our client’s case later on when it comes time to resolve.

At PLG, we will file cases no later than 6 months prior to the statute of limitations, because we want the time to guide and advise our clients to prevent mistakes that would negatively affect their case. Most importantly, we want to make sure that our clients have the time to see all the necessary medical providers and receive the treatment needed to help them recover physically, emotionally, and financially from their injuries.
