This case is a great lesson in car insurance limits and a story of never giving up. Esla is an elderly woman in her 80s and she was crossing a crosswalk in Bellevue. A car was making a left-hand turn and struck Esla in the crosswalk. Even though she had the right of way, it is not uncommon for drivers (especially those making a left-hand turn) not to see a pedestrian. The second most common serious accident is a car is making a right-hand turn and hitting a pedestrian. Prior to her accident, Esla lived with her son in a multi-story townhome. After the accident, Esla was no longer as mobile as she used to be, and she could no longer go up and down stairs. This required Esla to have to move into an assisted living facility. This new living arrangement was much more expensive than living with her son.
How Much Uninsured/Underinsured Motorist Coverage Do You Need?
As we mentioned at the beginning of this story, this case is a great lesson in auto insurance limits. Esla’s damages were far greater than $500,000. The driver that hit her actually had insurance limits that were higher than average. In Washington state, the minimum amount of liability insurance a driver must carry is $25,000. That can be a huge problem if your injuries, like Esla’s, are more than the other driver’s limits. A silver lining for Esla (if you can call it that), is that the other driver in her case had liability limits of $250,000. Even with liability limits 10x the state minimum, Esla’s injuries still vastly exceeded the insurance limits the other driver had. Thankfully, Esla had a $250,000 uninsured/underinsured motorist coverage on her auto insurance. Even though Esla was a pedestrian, a great feature of uninsured/underinsured motorist coverage is that it covers you even if you are a pedestrian.
The primary function of uninsured/underinsured motorist coverage is that it protects you in case the other driver causes injuries to you that exceed what their policy limits are.
