Whether you’re entitled to medical leave doesn’t have a simple answer. The law is very complicated in this area. Under the Family Medical Leave Act, employers with more than 50 employees, and the employee works more than 1,250 hours the preceding year, may be entitled to medical leave for up to 12 weeks.
However, even if the employer does not meet those criteria, the employee may be entitled to some sort of medical leave under the disabilities laws. You should consult an attorney and get their advice before proceeding one way or the other. Questions? Call us at 206-285-1743.
