Your passenger has a claim against any and all at fault drivers. So, if the accident wasn’t at all your fault, then they only have a claim against the other driver. However, if an argument can be made the accident was partially your fault then yes, they will have a claim against you as well as the other driver. And, of course, if the accident was solely your fault then they’ll have a claim against you solely. Additionally, they may be entitled to PIP coverage under your PIP policy so that’s something that you should check into that will help them get their medical bills paid.
