Expert Brain Injury Attorneys in Washington

| Uncategorized

Brain injuries can be devastating on a victim’s day-to-day life, affecting areas like cognition, memory, mood, and motor function. The Centers for Disease Control and Prevention (CDC) estimates that 1.5 million Americans endure a traumatic brain injury every year. Brain injuries are caused by falls, violence, and motor vehicle accidents. If you have sustained a brain injury due to someone else’s negligence, speak with a Washington traumatic brain injury attorney for an assessment of your case.

Brain injuries can be difficult to detect because symptoms can be dormant for a long period of time before they begin to affect your daily life. Especially when left untreated, brain injuries can have major repercussions on your health and wellbeing. At Premier Law Group, our Washington traumatic brain injury lawyers have extensive knowledge in handling serious injury cases. We understand that brain injuries can impact your ability to work and put further pressure on paying for medical bills and other expenses long-term. We are passionate about helping you obtain the compensation you deserve and the justice you are owed.

Understanding Traumatic Brain Injuries

Traumatic brain injuries (TBI) are caused by a direct blow, bump, or jolt to the head, or a penetrating injury. Car accidents cause the majority of traumatic brain injuries, but anything that produces a hard knock to the head, such as sports, slipping and falling, or a work accident, can result in a TBI as well. Even mild TBIs can have lasting symptoms.

Not all brain injuries are the same, though. They vary in severity, from affecting one region of the brain to affecting multiple or all regions of the brain. Proper treatment may allow for recovery, but that is not always the case. It is crucial that victims seek immediate medical attention to increase their chances of recovery following a traumatic brain injury accident.

These injuries are very serious and may require long-term assisted care. If you have endured a brain injury, speak with an experienced Washington traumatic brain injury lawyer for an assessment of your case.

Funding Recovery: Who’s Responsible in Washington?

A traumatic brain injury can be life-altering, and the costs associated with having a TBI can be immeasurable. These costs may include:

  • Hospital bills
  • Property damage
  • Ongoing care
  • Travel expenses to visit facilities that specialize in traumatic brain injuries

Typically, the person who caused the accident to occur has to pay through their insurance policy. However, they will often want to settle your claim quickly, and you will not get the money you deserve or even what you need.

A lump sum upfront may seem like it will be enough, but the ongoing care you or your family member will need is usually not determined so soon after the accident. It is crucial that you speak with one of our experienced Washington traumatic brain injury attorneys to determine the maximum compensation you are owed for your damages.

It is very important that you do not settle right away with the insurance company if you have any reason to believe that you may have suffered a brain injury. Sometimes the injury can result even without the head striking anything. In severe whiplash cases, the brain may strike the interior of the skull, causing serious injury as a result. If the accident was caused by someone else, the traumatic brain injury lawyers at Premier Law Group are here to help you recover the money you need.

Compensation Types for Traumatic Brain Injury Victims

Due to the complexities of traumatic brain injuries, there are many layers of expenses that can be included in compensation. Some of the damages you may be eligible to collect include:

Addressing Medical Costs After a Brain Injury

This is the most obvious and likely the largest expense because treating a brain injury typically results in long hospital stays, intensive care, and sometimes life support.

Additional Expenses: Beyond Medical Bills

These include things that your medical insurance may not cover as well as travel expenses and many other expenses incurred related to the injury.

Quantifying Emotional Distress & Pain

This can include anything from actual pain and suffering to loss of enjoyment and quality of life. This includes physical, mental, and emotional pain and suffering.

Recouping Lost Wages After a Brain Injury

Because of hospital stays, doctor’s appointments, and even short or long-term disability, you are likely to lose income from your brain injury. Loss of income results from missing work or being unable to perform your normal work duties.

Understanding Compensation for Relationship Strain

Losing relationships that were important to you or your loved one is often a side effect of traumatic brain injuries. The long-term effects of a TBI can be devastating, especially for family and friends.

Why Engage a Washington Brain Injury Lawyer?

Premier Law Group provides complimentary consultations to review your TBI case. We also have a Zero Fee Guarantee, which means you pay nothing unless we win your case. The first step we take is helping you decide whether you even need a lawyer—if you can settle your case on your own, our free consultation can help provide the legal guidance you need to do just that.

For more complex cases, you may require an attorney to get the best settlement possible. The trauma you experience post-accident can be the tip of the iceberg. Permanent damage and lasting consequences of the accident may not be discovered for years down the line. Insurance companies will pressure you to settle before you know the full extent of the impact of an accident. When you work with one of our skilled attorneys, you work with an experienced TBI attorney who will:

  • Listen carefully to your needs, questions, and concerns about the traumatic brain injury lawsuit process
  • Handle all the legal issues so you can focus on healing
  • Deal with the insurance companies—sometimes multiple insurance companies will be involved
  • Order all medical records and bills related to your injuries

The Wide-reaching Effects of Traumatic Brain Injuries

As well as injuries to the spinal cord, there are other frequent injuries stemming from TBIs. Accidents resulting in a traumatic brain injury can also result in paralysis, spinal cord injuries, neck, and other back injuries, speech, hearing, vision, and other sensory losses.

Connecting Brain Injuries with Spinal Cord Issues

Spinal cord damage can impact different regions of the body and can range from mild to severe depending on the scope of the damage. Commonly, nerve damage in the spinal column results in symptoms such as loss of sensation and paralysis. To identify where the spinal cord is damaged, medical professionals describe the location by letter and number correlated with the affected vertebrae. The following are identifying spinal cord injuries associated with paralysis and other symptoms:

Cervical Spine Injuries: Delving into C1-C8

Damage to the cervical spine, affecting vertebrae C1-C8, protects the upper portion of the spinal cord. When these vertebrae sustain an injury, victims can experience symptoms such as extreme weakness or paralysis in the limbs. Damage to this region of the spine is generally more catastrophic due to the proximity to the brainstem. Symptoms may include:

  • Inability to breathe without equipment
  • Loss of sensation
  • Lack of bowel or bladder control
  • Requiring a brace or permanent stabilization

The more superior the injury is on the spinal cord, the more critical the paralysis can be. If the damage is in your neck, it may cause quadriplegia, paralysis of all four extremities, and often requires the use of a ventilator. Catastrophic injuries may take a toll on victims and affect their emotional and financial well-being. Speak to an experienced paralysis injury lawyer for an assessment of your case. We work to fiercely negotiate on your behalf in order to recover the losses you’ve experienced.

Understanding Thoracic Spine Injuries: T1-T12

Damage to the middle spine, or thoracic spine, may result in partial or total paralysis of the lower extremities. Victims affected by a catastrophic injury to the lower spine often experience the following symptoms:

  • Loss of sensation
  • Lack of bowel or bladder control
  • Tingling in the limbs

Victims who experience damage to their T1-T12 vertebrae may be able to retain use of their arms but will often be restricted to a wheelchair.

Lumbar Spine Impact: Exploring L1-L5

Damage to the lumbar spine, located in the lower back, can cause loss of motor function in the lower extremities. These types of injuries typically do not affect the use of your arms. L1-L5 injuries range in severity depending on the location and impact of the blow. Symptoms may include:

  • Lack of control in the glutes, genital organs, and abdomen
  • May require surgery

If you have been injured in the lumbar spine due to negligence, speak to an experienced Washington paralysis injury lawyer for an assessment of your case. A knowledgeable paralysis attorney can assist you in building a comprehensive case in order to pursue the compensation you deserve.

Assessing the Consequences of Sacral Spine Injuries: S1-S5

Sacral spine injuries, located in the upper gluteal region, can impair the following bodily functions:

  • Lack of bowel and bladder control
  • Movement of the hips and legs
  • Control and strength of the thighs
  • Sensation and movement in the calves, feet, and genital organs

Even though this is low in the spine, injuries to the S1-S5 can still be life-altering for the victim.

Top Reasons Behind Brain Injuries in Washington

We often see many causes of brain injuries stem from motor vehicle accidents but there can be other frequent causes of brain injuries, spinal cord injuries, and paralysis such as:

  • Traumatic Brain injuries
  • Car accidents
  • Strokes
  • Nerve injuries
  • Cerebral palsy
  • Multiple sclerosis
  • Slips and falls
  • Diving accidents
  • Sports accidents
  • Violent crimes

Help for Victims of Post-Traumatic Seizures

brain injury seizure scanA brain injury seizure is one of the scariest, most traumatic head injury accidents that a person can suffer.  Injuries to the brain cause coma, and greatly impact a person’s ability to recover from the accident.

Most people do not realize that anyone who goes without oxygen for four minutes or more will be left with long-term brain damage.  Also, each part of the brain has its own set of risk factors for suffering traumatic brain injury seizures.  Therefore, brain injury seizures depend greatly on which part of the brain has received the injury.

Have you or a loved one suffered a serious life-changing traumatic brain injury seizure?  Did you lose someone you love to this kind of accident?  Are you dealing with horrendous medical bills?  And rightly scared for your future?

Let Premier Law Group help!

Clearly brain injuries change people’s lives.  In addition, brain injury seizures have long-lasting impacts and side effects that make recovery extremely difficult.  These injury accidents lead to life-changing situations for the whole family.   For example, most brain seizure injury victims can never drive again, nor return to work.   If the brain seizure injury accident was caused by someone’s negligence, you need an attorney as your claim partner.   Premier Law Group’s expert personal injury lawyers know the best next steps.  We negotiate on your behalf, while the accident victim focuses on recovery.  Let us collect all the accident evidence, determine negligence and fault, and manage the claims process for you and your loved ones.

What is a Brain Trauma Seizure?

Brain trauma seizures are also known as post-traumatic seizures (PTS).  These electrical events occur in the brain and cause a range of serious symptoms.  For example, during and after seizures, victims are dizzy, confused, and don’t recognize their surroundings.  In addition, victims who have more frequent and longer lasting seizures require constant care due to intense pain and debilitating side effects.

By and large, brain seizures happen in the first few days or even weeks after the original brain injury.  But, this is not always is the case.  The scary fact is that some accident victims suffer brain injury seizures months or even years after the brain injury.

Symptoms of Brain Injury

In the immediate aftermath of a brain injury accident, victims are not aware of the significant signs of brain trauma.  That’s why it’s so important that people you love be around you, after suffering a traumatic brain injury.

Brain injuries cause symptoms that are observed by loved ones.   These symptoms include the following:

  • Extreme sleepiness, dizziness or exhaustion
  • Nausea and/or vomiting
  • Sound and/or light sensitivity
  • Noticeable change in attention span, speech patterns, and other normal functions
  • Dilated pupils in one or both eyes
  • Migraine headaches or headaches that get worse
  • No interest or curiosity in things the victim loves – children, pets, tv shows
  • Confusion, disorientation, extreme sadness or depression

If you or someone you love shows these symptoms following a brain injury, immediately get medical help.  Victims suffering traumatic brain injury symptoms need follow-up injury diagnosis and treatment.

How Can You Tell if Someone Has Had a Post-Traumatic Seizure?

There are some tell-tale signs that a brain injury victim will display, immediately following a brain injury seizure.  The following are indications that immediate medical care is needed:

  • Staring into space at nothing, not engaged with their surroundings
  • Smacking their lips, chewing “air”, and fumbling around
  • Repeatedly shaking or stiffening the head, body, arms, legs, eyes, or other body parts
  • Seeing things, having visions, smelling and tasting things, and feeling things that no one else around is seeing, smelling or experiencing
  • Sudden bouts of dizziness and extreme tiredness
  • Loss of speech and an inability to understand what other people are saying.

What is a Traumatic Brain Injury

doctor diagnosing a traumatic brain injury TBITraumatic brain injury (TBI) is defined as any sudden injury that bumps, jolts or shakes the brain inside the head.  There are many different causes of TBIs and equally different levels of injuries.  For example, “closed head” injuries are lumps and bumps where no skin is broken.  And there are “penetrating head” injuries where something breaks through the skin and into the skull.

Some of the most common causes of closed head TBI include:

Penetrating traumatic brain injuries are caused by the following:

  • Hit by bullets or shrapnel
  • Hit on the head with a weapon – a hammer, baseball bat, etc.
  • Other head injuries that shatters the bones of the skull and penetrate the brain

There are also many other injury accidents caused by natural disasters, and explosions that cause both closed head and penetrating head TBIs.

What Seizures Mean for Victims and Their Families

Victims with brain injury seizures do not know when a seizure is going to happen.  Victims have no control over when they happen or how long they last.  During a seizure, victims cannot talk, and they lose control of their bodily functions, including bladder and bowel.  Oftentimes, seizure victims bite their tongues and insides of their mouths.

A severe seizure leaves the victim exhausted, confused, and unable to stand or walk.  Some prescription drugs do help people manage their seizure symptoms.  But these medications are known for causing serious side effects, like the following:

  • Sleepiness and fatigue
  • Dizziness and loss of balance
  • Uncontrollable trembling
  • Double vision
  • Confusion and inability to concentrate

It’s easy to see that it is nearly impossible for brain injury seizure victims to drive or operate any vehicle, even a bicycle.  In fact, some states require physicians to report patients who have had seizures to the Department of Motor Vehicles.

Example:

For example, Washington State does not require physicians to report seizure patients to the DMV.  But Oregon, California, Montana and Nevada revoke physicians’ licenses if they do not report seizure patients to their DMV’s.  As a caveat, these states do have “seizure free” periods.  In other words, victims must be “seizure free” for a designated period of time.  In some states, it is 3 months while others, it’s 6 months.  Regardless, a doctor has to provide a certification of the seizure free period to that state’s DMV.

Other safety concerns for brain injury seizure victims include the following:

  • Victims need someone with them when they are in water – bath tub, pool, lake, ocean
  • Seizure victims should never climb ladders, roofs, trees and any other tall objects
  • Caregivers should never put anything in the seizure victim’s mouth – you can get bitten
  • Also caregivers need to make complete notes about the seizure – date, start time, ending time, and what happened during the seizure
  • Victims do need to alert people around them to your seizure potential and tell them what to do if you have a seizure

If you or your loved one has suffered a brain seizure injury caused by someone’s negligence, it is important to find a legal partner to help you get the compensation you deserve.

Why Choose Premier Law Group To Handle My Case?

It’s no surprise that victims and their families need legal help after a brain seizure injury accident.  There are many compelling reasons that require the help of an experienced personal injury attorney.

For example, you may not receive any insurance claim monies for your injury.  Or the negligent party’s insurance claims agents may be denying your claims.  You and your family do not know what your next steps should be.  Meanwhile your condition has worsened, the medical bills are piling up, and you are unable to work and take care of your family.

Getting Legal Help

Anyone who suffers brain injury seizures just want the symptoms to go away.   You want a clean bill of health, and be able to move on, living your life.  But brain injuries do just the opposite.  They change your life.

In fact, brain injury seizures prevent you from living the life you had prior to the accident.  The seizures and myriad of other symptoms get in the way of regaining health and a full recovery.

Our experienced attorneys have firsthand experience, helping those with brain injuries in accidents caused by other’s negligence.   We help you find the best medical care who will guide you through recovery.  While you work with the medical team, and focus on regaining your health, we work on gathering the accident details.  Our goal is to get you fair compensation from the people who caused your injuries.
