Delays Can Damage Your Case

Statutes of Limitations

There are hard and fast deadlines for injury cases built into the legal system. These are called Statutes of Limitations, and they are rules that limit the span of time in which you can bring your injury case to trial. If you delay speaking with an attorney for too long, your case may fall outside the Statute of Limitations period and you will not be able to recover compensation.

An experienced personal injury attorney won’t rush your case. The more time we have to work with you, the stronger your case will be and the better our position to negotiate with the insurance companies. If you have been seriously injured in an accident and want to put together a roadmap for your case, call us at 206-285-1743 to speak with our friendly and knowledgeable staff.

How are pain and suffering determined in Federal Way, Washington?

The concept of pain and suffering in a personal injury claim includes both the tangible and intangible impacts on the victim. These can include the pain and suffering that resulted from their physical injuries, but it can also include the pain and suffering inflicted on them through monetary loss, mental anguish, and other consequences negatively impacting the quality of life of a person after the accident. One way that can help to determine pain and suffering in a personal injury claim in Federal Way, is to ask yourself the following question: what amount of money would make up for all the pain and suffering that you were forced to endure due to the negligent actions of another? Put differently, in order to “make you whole” as a result of your injury, what amount of money would you need to put you back in the same situation that you were in prior to experiencing the injury?

What is the statute of limitation for a personal injury claim in Federal Way, WA?

The statute of limitation (SOL) to file a personal injury claim in Federal Way, Washington is 3 years from the date of the incident. In order file a personal injury claim in Federal Way, Washington you must ensure that you file within the set time limit, or your case will mostly likely be dismissed.

How much is my personal injury claim worth?

Unfortunately, no one can truly give you an honest answer to this question during the early stages of the claims process. In order to know the nature of your injuries and full extent of damage caused, you must complete your medical treatment and follow all of your doctor’s recommendations. You should also remember that every claim is different because every person is different. Therefore, an accident that causes a personal injury will impact different people in different ways. Focusing primarily on your recovery is most important. When you have completed your medical treatment, your attorney can review your medical records to determine the highest possible value of your personal injury claim and prepare a demand package to submit to the insurance company.

Frequently Asked Questions About Personal Injury in Bellevue, WA

How do I know if I have a personal injury case in Bellevue, Washington?

If you have been injured because of the negligent actions of someone else, then you may have a personal injury case. In Washington State, negligence is considered the failure to exercise “duty of care” that causes serious injury or harm to another. Personal injury cases can range in type and severity—from serious car accidents to wrongful death. If you or a loved one has been injured due to the carelessness of another, you should consult with a Bellevue personal injury attorney who can help you determine the type of case you may have and what steps you should take to recover compensation for your suffering.

What is the statute of limitations for a personal injury claim?

In Washington, the Statute of Limitations (SOL) for a personal injury claim is 3 years from the date of the incident. If you have been injured due to the negligence of another, you have 3 years from the date of injury to file a personal injury claim to recover damages. If you do not meet this deadline, within the set time limit, your case may likely be dismissed, and you may not be able to recover any compensation for the injuries you’ve sustained.

Will my personal injury case go to trial in Bellevue, WA?

There are many factors that might influence whether your Bellevue personal injury case goes to trial in King County. The bottom line is that it will depend on your unique case and the settlement that the insurance company offers. If, after you have finished treating with your medical provider and your attorney has reviewed your medical records to create a demand package to be sent to the insurance company and you are then offered a settlement that you believe does not cover the full extent of the damages done to you by the accident, then with the help of your attorney, you can determine how to proceed and whether to file a lawsuit. The truth is, though, that since every case is different, the answer is not simple and will vary from case to case. This is why if you have sustained a personal injury in Bellevue, you should consult with an experienced personal injury attorney and consider hiring them to assist you on your personal injury case.

Eye Injury and Vision Loss Attorneys in Seattle

Legal Aid Following an Eye Injury or Vision Loss

Many people take their vision for granted. We don’t think about how fortunate we are to be able to see.  However, an eye injury can result in partial vision loss or complete blindness.  It can also lead to a long, painful recovery, which could negatively impact your life. It could also leave you unable to work if you can’t perform the tasks needed for your job any longer.

If someone has caused you a serious eye injury, then you deserve compensation. Eye injuries are expensive, and not only because of medical bills. Without vision, you may need to switch careers, modify your home, or even work with an aide who can help you in your day-to-day life. You should not have to shoulder this financial burden alone, especially if your accident was someone else’s fault.

Contact one of the qualified Seattle personal injury attorneys at Premier Law Group today. Call 206.285.1743 to get started on your FREE case review.

Causes of Eye Injuries

Although some diseases can result in partial or total blindness, accidents are far more likely to cause eye injuries and vision loss. Because your eyes are so delicate, and always exposed, any trauma to the eye, or to the brain, can result in serious injury. Vision loss is very common following a severe injury.

Some of the most frequent accidents that lead to these injuries are:

If you are suffering from any of these accidents, then you may be currently suffering from vision loss or damage to your eyes. Although the bills may be costly, it is important to get immediate medical help if you have not already. Nothing is more important than your health, and eye injuries can result in lasting consequences.

Eye Injuries

The human eye has a number of different parts, and all of these parts work together to allow us to see properly. When even one of these components has damage, it can affect the entire eye. Even smaller injuries, such as a scratch to the cornea can lead to more serious complications. For instance, a damaged cornea can leave the entire eye susceptible to infection.

Common Eye Injuries

There are a variety of ways that your vision could suffer. Some of the most common are:

  • Penetrating injuries: These often result from car accidents, and involve something actually entering and damaging the eye. These injuries can result in total blindness as well.
  • Chemical burns to the eye: This type of eye injury is possible at construction sites, workplaces, and even schools. These burns cause redness and burning in the eye, and cause a great deal of pain. They can also damage your vision permanently, depending on the chemical and how long your eye was exposed before flushing out your eye.
  • Traumatic iritis: This is a very common injury to the iris. It is inflammation caused by blunt trauma to the eye. Though the inflammation usually resolves itself, infection is a serious risk and can also permanently damage your vision.
  • Swollen eyelids: Swollen eyelids are a sign of eye damage following an accident. In these cases, the eyes have suffered blunt trauma, and the eyelids have swollen so much that the eyes are practically shut. Swollen eyelids usually heal on their own, but there is always the potential for infection. Other serious conditions could arise as well if the eye does not get proper treatment.

Not all eye injuries are immediately obvious. In fact, one of the most common causes of vision loss is the brain, and is not noticeable to the eye at all. In such a case, your eyes may be operating perfectly, but damage to your brain can leave you with slight or complete vision loss.

Loss of Vision & Brain Injuries

Although injuries directly to your eye can cause vision loss, you can still lose your vision when your eyes are functioning normally. Your eyes are only a part of how you see. They take in light through the pupil. This light is then converted into information. This information then goes through the optic nerve to the occipital lobe, in the back of the brain. The brain finally takes this information and converts it into an image, allowing you to see. The entire process takes milliseconds, however, you sense no delay between what you are seeing and what is actually happening.

Due to the role it plays in your ability to see, if the occipital lobe has damage, then you could lose your sight, partially or completely. On the other hand, if your optic nerve, which runs from your eyes to your brain, has damage, that could also lead to partial or full loss of vision. If you experience a blow to the head, you should seek medical attention right away.  Even if you don’t notice any loss of vision right away. The injury can take time to cause blindness, and any treatment available will be time sensitive.

Cases Involving Ankle Fracture Injuries

Malleolar Fracture attorneys in Seattle Renton Bellevue and Federal WayIn malleolar fracture cases, permanent damage is possible. These fractures can also make it difficult to sit, stand, run, or walk. For some victims, the pain lasts for a long time. These fractures can also happen in a variety of ways. Furthermore, there is often no way to avoid the accidents or injuries that lead to the fracture. In many cases, the accidents are caused by another person’s negligence as well.

Victims who suffer from malleolar fracture injuries can also be severely impacted over a long period of time. This also makes earning a living or living free from pain difficult.

If you’re suffering from this type of injury, contact the personal injury lawyers at Premier Law Group today. Call 206.285.1743 to begin your FREE case review.

Malleolar Fracture Injuries

Malleolar fractures are fractures involving the ankle bones. Ankle fractures can occur in any of the three bones that make up the ankle. This includes the shinbone, the smallest bone in the lower leg, and the small bone that sits between the other two bones and the heel bone as well.

Ankle fractures can be simple or complex. Simple ankle bone fractures involve a small break in just one of the bones in the ankle. Complex ankle bone fractures may involve multiple fractures in a single ankle bone or fractures in multiple ankle bones. Malleolar fractures can also be small hairline fractures, compound fractures, or clean breaks of the bone as well.

Victims with serious injuries to their malleolus may also sustain significant damage to their ligaments. This often results in additional pain, suffering, and a longer recovery time as well. Damage to the ligaments around the ankle bones can also cause problems because these ligaments hold the ankle bones in place. They support the ability to walk as well.

Types of Fractures

Medial Malleolar Fractures

These fractures happen to the medial malleolus. It is located on the inside of the shin bone where it connects to the other bones in the ankle.

Lateral Malleolar Fractures

These fractures occur to the lateral malleolus, on the end of the fibula where it connects at the ankle to the other bones.

Posterior Malleolar Fractures

These fractures occur at the rear of the malleolus, near where the ankle connects to the other bones.

What Causes Malleolar Fracture Injuries?

Malleolar fracture injuries can happen many ways. Some of the most common causes include twisting or rotating the ankle, rolling the ankle, tripping and falling, slipping and falling, and being crushed or otherwise impacted in a car accident.

Some other common accidents that lead to a malleolar fracture injury also include:

  • Falling down stairs
  • Tripping or severe impact while playing sports
  • Being knocked over in a dog attack
  • Slipping on the floor due to water or ice
  • Being struck by a car while walking or riding a bicycle

Symptoms of a Malleolar Fracture

Broken ankle lawyers Some of the common symptoms of a malleolar fracture include:

  • Severe pain
  • The inability to walk
  • Swelling around the site of the injury
  • Inflammation
  • Bruising at the heel, bottom of the foot, or ankle
  • Visible deformities at the ankle or the top of the foot.

Victims with these symptoms should also see a doctor for diagnosis and treatment right away in order to avoid prolonged suffering and permanent damage.

Diagnosing a Malleolar Fracture Injury

Doctors will usually diagnose malleolar fracture injuries with an x-ray. X-rays, along with your medical history, help the doctor determine the cause of any pain. This pain may be the result of torn ligaments, a twisted ankle, pulled muscles, or fractures in the bones at the ankle as well.

Treatment for and Recovery

Treatment for malleolar fracture injuries depends on the damage and the extent of any fractures. The treatment typically includes setting the ankle as well as placing it in the cast. However, casts are reserved for fractures that are non-displaced, or limited in severity.

Casting typically lasts four to six weeks depending on the severity of the fracture. However, victims who receive a cast can also see recovery times of up to eight weeks. Furthermore, this recovery involves keeping the ankle elevated, keeping the weight off the ankle, and taking pain and anti-inflammatory medications.

Serious breaks often require surgery and a longer recovery time also. Some of the most common reasons doctors perform surgery to treat malleolar fractures include:

  • Unstable fractures that could lead to permanent or more serious injuries
  • Subluxation of the talar
  • Incongruity of the joints in the ankle
  • Fractures that cause the victim’s step to be off by more than two millimeters
  • Serious disruptions of the ankle joint, ankle bones, and the surrounding ligaments.

In some cases, screws or pins are placed into the ankle joint or ankle bones to stabilize the fracture. Ankle surgery patients also usually have to wear a cast or boot, and keep the weight off of their ankle to allow for healing.

Long and Short-term Effects of a Malleolar Fracture

Malleolar fractures can inhibit the enjoyment of life over the short term.  These fractures can remove the victim’s ability to engage in activities that they once found enjoyable, like running, hiking, or playing sports.

A victim’s work and income may also be prevented if they rely on their ability to walk or do other types of manual labor. Additionally, pain and suffering can stick with victims over time.

Furthermore, any arthritis that accompanies a break in any part of the malleolus can reduce a victim’s ability to enjoy life or to perform major job functions. Complications that come with malleolar fracture injuries can also impair quality of life or the ability to work and earn a living. These fractures can also affect the overall mental and emotional status of the victim.

At Premier Law Group, we can help you recover from the emotional and financial effects of your malleolar fracture. Call 206.285.1743 today to speak directly with one of our Seattle malleolar fracture attorneys.

Other Complications of Malleolar Fracture Injuries

Malleolar fracture injuries don’t just keep the victim from walking, working, or engaging in daily activities. There are often serious issues that can come from these injuries as well. These complications include:

  • Osteoarthritis from the stress and pain of the break over time.
  • Compartment syndrome from pressure built up around the injury.
  • Burning pains caused by nerve damage.
  • Infection caused by bacteria entering the wound.
  • Disruption of the growth plate inhibiting the development of the body.
  • Inability of the wound to heal over time.
  • Deep vein thrombosis, or blood clots.
  • Reduced range of movement.

These complications can significantly lengthen recovery time for victims and add to the pain and suffering felt by victims.

How to Prevent Malleolar Fracture Injuries

Prevention of malleolar fracture injuries is difficult for victims because it can be difficult to predict when an accident might happen. However, there are ways that you can protect yourself to help decrease your chances of an accident happening. Some of the best ways to protect yourself include:

  • Paying attention to where you are walking, to avoid spills, broken flooring, debris, electrical wires and more.
  • Paying attention to the road and the other drivers around you while driving and wearing seatbelts as required by law.
  • When you are walking or riding a bicycle down the road, always double check before crossing the road. It is important to watch the traffic around you to ensure that you are not struck broadside by a driver.
  • Always use safety equipment while playing sports.
  • If you think you have suffered this type of injury, seek medical attention right away. Also, do not wait for treatment. Waiting could result in more significant or permanent injuries, which may not be repaired through casting, or even multiple surgeries.

Disseminated Purpuric Lesions causing hematoma injuriesUnfortunately, most everyone will have a hematoma injury sometime.  For instance:  have you ever had a swollen blood-filled purplish bruise?  If yes, then welcome to the club!  You, too, have experienced a hematoma injury.

Most hematomas just go away, as the swollen purplish tissues absorb all the collected blood.

But open head hematoma injuries are a whole other matter.  These injuries leave the brain “exposed” to contaminants – like bacteria, viruses, molds and other environmental elements.  In fact, hematoma injuries directly cause serious brain infections that many accident victims never recover from.

Have you or a loved one suffered a serious life-changing hematoma injury?  Did you lose someone you love to this kind of accident?  Are you dealing with horrendous medical bills?  And rightly scared for your future?

Hematoma Injuries Defined

What exactly are “hematoma injuries?”  Well, these happen when blood collects around the injured blood vessel wall.  As the bruise is forming, the blood builds up and seeps out into the surrounding body tissues.  This pool of blood has basically clotted and depending on the injury, it can form a sizable lump.

Most hematomas just go away with time, as the body absorbs the pool of blood.  Eventually, the body repairs and heals the blood vessel wall.  On the other hand, serious hematomas require medical care and far more healing time.  Oftentimes, they require surgery to remove the built up blood and to prevent blood clots from traveling the circulation system and into the heart or brain.

Hematoma injury Any trauma to a blood vessel wall will cause hematoma injuries.   For example:  you hit a fingernail with a hammer, and end up with a blood clot (hematoma) under the nail.  Over time, this kind of hematoma injury heals itself.  The swelling goes down as the blood is absorbed into the body tissues around the injury.

But serious hematoma injuries have a range of different causes.

For example, they happen in:

  • Auto Accidents
  • Falls
  • Invasive Surgical and Dental Procedures
  • Medical Conditions That Cause Side Hematomas
  • Medication and Supplements Side Effects
  • Spontaneous Hematoma with No Identifiable Cause

Types of Hematomas

Doctors have names for different hematoma injuries that are based on their location in the body.  Here are some examples and their description:

  • Subdural Hematoma:  a pool of blood, located between the brain tissue and the inside lining of the brain
  • Spinal Epidural Hematoma:  a hematoma located between spinal column vertebra and the outside lining of the spinal cord
  • Intracranial Epidural Hematoma:  blood pools between the skull and the outside lining of the brain
  • Subungual Hematoma:  a blood clot under a fingernail
  • Intra-abdominal, Peritoneal, or Retroperitoneal Hematoma:  any blood collected inside the abdominal cavity
  • Ear or Aural Hematoma:  a blood clot between the cartilage of the ear and the overlying skin
  • Splenic Hematoma:  a blood clot inside the spleen
  • Hepatic Hematoma: a liver hematoma injury

Symptoms of a Hematoma Injury

Hematoma injury on the brainSimple hematoma injuries are known for causing pain, swelling, redness, and big purplish bruises.

But more serious hematoma injuries have far more significant symptoms and health impacts.

It is so important that victims and their families know the symptoms so you can get the medical help you need.

Some of the symptoms are:

  • Subdural:  headache, neurological weakness on one side, difficulty speaking, falling, confusion, and seizures
  • Epidural:  severe back pain, overall core weakness, loss of bowel and bladder control
  • Subungual:  Nail pain and weakness,  loss of nail, disfiguring nail conditions
  • Splenic, Hepatic, or Peritoneal:   severe abdominal and flank of the body pain

Of all these hematoma injuries are particularly hard to find.  This is because the injury is not in any of the body’s organs.  It’s floating in the abdominal space, and the body cannot absorb it.  Abdominal hematomas allow toxic infections to take up house keeping in the victim’s body.  When this happens, the victim is in critical medical condition.  It is crucial that the injury victim get immediate medical care.

Negligence

|

“Negligence is a legal term used when determining fault. When someone is careless or doesn’t exercise due diligence while driving, and this causes an injury or property damage, they are deemed “negligent” and are then liable for the damages following the accident.”

Negligence is the basis in which all personal injury cases work off of. When driving, everyone has a responsibility under the law to uphold a level of care. Our careful behavior, or lack thereof, in these circumstances can have a huge impact on other people’s safety and wellbeing. Not abiding by the law while driving is negligent behavior. When someone is negligent and they cause another person injuries or property damage, they are also responsible to pay for those damages.

While this is a simple concept, the application of the laws can make it more complex. If you are filing a personal injury claim, you have to prove the other party was negligent. This can be challenging, especially if you’re not an experienced auto accident lawyer.

How Do I Prove Someone Was Negligent?

Proving someone else was negligent isn’t always obvious. If someone rear ends you, it is pretty straightforward who was at fault. The challenge comes when there are multiple parties involved, or when someone else’s story of how the accident occurred is different than yours. This is when having an expert auto accident attorney on your side makes the difference between winning and loosing your case.

Proving negligence in a car crash requires 4 elements. These four elements are:

  1. The other party had a duty to act with care. This legal duty can be established in many different ways depending upon the case type. In an auto accident it is simpler because everybody on the road owes a duty to everyone else to act reasonable depending on the conditions.  All drivers have a duty to exercise care and follow all laws while driving.
  2. They didn’t follow through on that duty. A car will never hit anything else unless someone breaches their duty to act reasonable.  The fact that there was an accident means someone breached their duty to whoever they hit, at a minimum.  If a driver was speeding and this caused an accident, then they breached their duty to follow the law and they are negligent. If someone lets their dog loose and it bites someone, they would be negligent for failing to maintain proper control over their pet.
  3. Their failure to follow through on that duty caused your accident. This is where you have to prove that your accident was caused due to the other driver’s negligence. This is often when an insurance company tries to say the accident was at least partially your fault, even if it wasn’t. Good lawyers use investigators, witness testimony, and physical evidence to prove what really happened and who is actually negligent given the facts.
  4. The accident caused damages. The law states that you can’t be compensated if you don’t have any actual damages. If you slip and fall at a restaurant but aren’t actually hurt, there is no damage caused, therefore there is nothing to sue over. Your damages then, are things such as injuries, medical bills, or wage loss.
