Negligence Per Se

|

Expert Federal Way car accident lawyersProving negligence is an essential part of nearly all personal injury cases. Generally, this is when someone is being careless or reckless while driving. This comes with a specific set of facts that will need to be proven in a personal injury case. Proving these facts can be difficult, however if you can prove that the defendant violated a law and this violation caused an auto accident, then it is much easier to prove that they were at fault. We call this Negligence Per Se.

Examples Of Negligence Per Se

An easy way to understand negligence per se is through a few examples. The most common example would be through a Washington car accident case. When a driver isn’t following the rules of the road, and this causes an auto accident, they are then at fault for the accident. The most common occurrences of this are:

  • Speeding
  • Running a red light
  • Running through a stop sign
  • Failing to yield to pedestrians or other vehicles when they have the right of way
  • Failing to use a turn signal when changing lanes or turning
  • Talking on the phone or texting while driving

Negligence per se isn’t just limited to car crashes. A dog bite case is another great example as well. Let’s say that someone is in an area with a leash law, and they let their dog off it’s leash. If the dog bites someone, then the owner would be responsible because they were negligent per se in not following the leash law. The owner is then liable to cover the costs for any injuries their dog may have caused.

So If I Prove Someone Was Negligent Per Se, Does That Mean I’ll Win My Case?

best car crash attorneys in Federal WayNot necessarily. Although proving that someone was negligent when causing your accident is great for your case, it doesn’t mean that you’ll automatically win. The insurance adjusters will try to deny any and everything that they can. Even if their client was at fault, it is very common for adjusters to say you were also partially or equally at fault. When this happens, you can expect a complicated legal battle to follow.

Proving someone was negligent is good grounds to stand on, but hiring an expert auto accident attorney puts the nail in the coffin for the insurance company. At Premier Law Group, our professional attorneys have decades of experience. We’ve helped hundreds of people win personal injury cases that adjusters wouldn’t have settled without a battle. Not only will we fight for you, but we’ll win too! Give us a call for a FREE consultation at 206-285-1743.

Lawyer

|

A lawyer, also known as an attorney, is someone who practices law. In Washington, lawyers have to be licensed by the state to practice law, and that requires extensive schooling and testing—or a certain level of experience and licensure in another state.

Lawyers have thorough training and knowledge regarding the law.  It is their business to know your rights in your legal case.  Many attorneys will specialize in specific areas of the law because it would be impossible to know every aspect of every category of the law.

Attorneys who work in personal injury matters, such as car accidents, slip and fall cases, and dog bite claims, practice in the category of “torts.” Many lawyers will also further specialize their practice by only starting or by only defending lawsuits.

Why should I have a lawyer for my personal injury case?

Technically, you do not need an attorney to start a lawsuit.  That being said, it is a smart move to have one, because attorneys bring a lot of value to your claim.  Lawyers who practice in personal injury cases see cases like yours every day.  They can put that knowledge and experience to work for you by:

  • Evaluating your situation to determine what the value of your claim may be compared to similar cases in your area and how likely you are to win your case at trial
  • Negotiating with an insurance company, employer, or anyone else who may be involved in your case
  • Investigating the accident
  • Gathering and analyzing medical records on your behalf
  • Knowing what they will need to be able to prove to win your case
  • Presenting your case to a judge, jury, or insurance adjuster in the best way possible

Unfortunately, many people hesitate to get a lawyer, which stems from the misconception that they are expensive. Premier Law Group uses a contingency fee agreement, which means that if we don’t recover anything for you, then you don’t have to pay us anything.  You get a lot of value with no payment up front.  Also, research shows that you are significantly more likely to win your case and/or get an increased settlement amount if you have an experienced attorney on your side.

Why does it matter what kind of lawyer I get?

No one lawyer knows everything.  Many attorneys specialize in just a few areas of the law so they can understand that particular area very well.  That is why you don’t want the same attorney who made your will to help you with your personal injury case.  They likely do not have the experience, knowledge, and skill you need to present a compelling argument after an auto accident.  That doesn’t make that person a bad lawyer! It only highlights the difference between a general practitioner and a specialist. Just as you wouldn’t use your family doctor to perform a spinal surgery, similarly you will get better results in hiring an attorney that specializes only in personal injury law.

Meeting with us is the best way to determine if you have a legal claim and decide if you want to work with our team to start your lawsuit.  We would love to talk to you about your options.  Fill out the form to your right or call us at 206-285-1743 to speak with one of our attorneys for FREE.

Personal Injury

|

Personal injury is any damage or loss that affects a person’s body. This also includes mental damages even though they may not have a physical side effect in some cases. Personal injury is a broad category of legal claims that affect the body. Most of these types of claims are also known as “torts.”

What Are the Types of Personal Injury Claims?

Any kind of incident that affects someone’s body could be considered a personal injury claim. The most common types include:

Car accident cases are by far the most common personal injury case in Washington and throughout the United States. Personal injury cases allow an auto accident victim to make the injured party whole again by allowing them to recover money from the person/company responsible. These damages often include things like lost wages, medical expenses, and even pain and suffering that you experienced because of the accident.

How Do I Prove a Personal Injury Case?

Most personal injury cases require that you show that the other party involved was negligent. This would require showing:

  • The other person owed you a duty of care (i.e. to watch where they were driving)
  • They violated that duty (i.e. they followed you too closely and rear-ended your car)
  • The violation caused you harm (i.e. the crash caused your injuries)
  • You suffered damages because of their actions (i.e. you missed time from work and had to pay medical bills)

You must prove these things regardless of what type of personal injury case you are claiming. Certain circumstances however, such as medical malpractice or dog bite cases, have very specific additional requirements as well. These factors may be easier (or in some instances, more difficult) to prove in some types of personal injury cases compared to others.

Can I Still Have a Personal Injury Case Even If I Wasn’t Hurt Very Badly?

Yes. While most claims involve some type of physical injury, you may still have a claim even without an injury. Consider, for example, a car accident case where someone T-bones you. The accident was at a slow speed, and you’ve suffered only minimal physical injuries. You may decide to only make a claim for the property damage that was done to your car, instead of also including a claim for your injuries. While a car accident is a common type of personal injury claim, you can choose to only bring the property damage portion of that claim as part of a lawsuit.

While you’re certainly allowed to divide up your claims after a situation like a car crash, it may also be a good idea to include some type of demand for your physical damages, even if it’s slight. It’s much easier to assert all of your losses at one time than to try to bring a case later.

Regardless of what type of personal injury claim you may have, Premier Law Group can help. Our team can help you determine whether you have a legal claim and what you should do next. Fill out the form to your right or call us at 206-285-1743 to get your FREE consultation today.

Claims

|

Claims are legal rights you assert against another person or party. A claim can be made for money, property, or for a certain type of action (like the return of personal property, etc.). Most claims are for money to compensate for financial losses that someone has incurred after an accident or similar incident.

The term “claim” is also used for other actions other than lawsuits, such as workers’ compensation and getting Social Security benefits. Any legal right to money, property, or benefits can be considered a claim. In a legal setting, there are a few ways claims are used.

Types of Legal Claims

There are several types of claims in the legal context. A claim typically will fall into one of two categories: equitable claims or legal claims.

Legal Claims

A legal claim happens when someone else causes damage to you or your property and you would like them to reimburse or repay you for those losses. In order to prove your claim, you must meet certain qualifications and your damages must have a direct correlation to the accident.

If you were injured in an auto accident for example, you wouldn’t have had to pay medical bills or go through surgery if the accident hadn’t happened. That is why the goal of this type of claim is to make you whole again. In this case, the person who caused the damage should have to reimburse you for those costs. Most personal injury cases are based on legal claims, including:

Equitable Claims

An equitable claim asks for a different type of damage than a legal claim. These damages may include money, but usually are based on an underlying notion of fairness. This may ask for items that are not monetary in nature, like the performance of an action that was previously agreed upon or an injunction (which prevents some action from occurring). Specific performance may require someone else to do something, such as complete a contract, while an injunction stops someone from taking a specific kind of action. These remedies sometimes help avoid or limit damages that may happen in the future.

Insurance Claims

Technically, legal claims and insurance claims operate separately from each other. Asserting a claim with an insurance company uses a process that doesn’t depend on legal requirements. Each insurance company has its own reporting requirements that must be followed so you don’t accidentally waive your ability to make a claim against your own insurance company.

If a claim is not honored or it is rejected or ignored, the next step may be a lawsuit.

Regardless of the type of claim you have, Premier Law Group can help walk you through your unique situation. Our attorneys have decades of experience helping people just like you work through any type of claim. Let us start by giving you a FREE consultation to discuss your case. 4 Reasons to Consider Hiring a Personal Injury Attorney

| Blog, Personal Injury

Calculator on a car insurance contract

A common question I get asked by people who call in after an injury is, “How do I know if I should hire an attorney?” Typically, just the fact that the person has taken the time to call an attorney is the first sign that they have realized they probably need some help. My answer to this question sometimes varies, depending on the situation, but a good general rule is that if you have an injury that hasn’t resolved in a month, despite you getting treatment, then you should seriously consider hiring an attorney to help you with your claim. Here are 4 reasons to consider hiring a personal injury attorney.

1. Insurance Adjusters Handle Hundreds of Claims A Day

One of the main reasons to hire an attorney is the simple fact that when you file an insurance claim, you are likely entering an arena where you have little to no experience. Making things worse is that you are negotiating against an insurance adjuster who has received countless hours of professionalized training in negotiating and settling claims for AS LITTLE $$$ AS POSSIBLE. As you can see, the deck is stacked against you, and one of the ways to even the playing field is to hire an experienced personal injury attorney to advocate on your behalf.

2. Insurance Adjusters Work for the Insurance Company, Not You

Another thing to consider is that, despite their often pleasant demeanor and willingness to “help” you, the insurance adjuster does not work for you and in most instances, has no duties to consider what is in your best interests. This often gets confusing for people who run into interference with their injury claim from “their own” insurance company. Even though you have been paying those monthly premiums, the insurance adjuster’s job is to keep the insurance company’s costs as low as possible, even if this comes at your detriment. This is yet another reason why hiring an experienced attorney is often a good idea, because they will be there to make sure that you are protected and to make sure that the insurance company is adjusting your claim pursuant to state and federal guidelines.

3. An Attorney can help you avoid hurting your case

While it is true that there are things you can do that can hurt your case, a lot of people don’t realize that you can also hurt your case simply by doing nothing. In certain situations, failing to take action (like failing to get treatment or follow up on a referral) can be as bad, or worse, as doing the wrong thing. Having an attorney can help you avoid giving the insurance company extra ammunition in their quest to give you as small of a settlement as possible.

4. Disputed Liability

The most sure-fire sign that you need to hire an attorney is when you get told that the other insurance company is disputing who was at fault for your injuries. Even though the other driver told you “sorry” at the scene of the accident, they may have a change of heart when they talk to their adjuster and are faced with the financial realities of having their premiums go up. Liability disputes throw a huge wrench in the resolution of a claim, so having an attorney who know the law and knows what evidence is needed to prove fault is key.

How Much Does It Cost To Hire A Seattle Personal Injury Lawyer?

The personal injury lawyers at Premier Law Group work on contingency fees. This means that we charge a percentage of the monetary compensation you receive once we settle or win your case. If we don’t settle or win your case, there’s no legal fee. Generally, people prefer contingency fee arrangements because they don’t have to pay money upfront.

Do You Have A Personal Injury Case?

In theory, if you were injured because someone else was negligent, you have a case. This is based on negligence laws in Washington State. Our laws define negligence as failure to exercise a duty of care. This is the type of care that an average and reasonable person would use under the circumstances.

The best way to learn whether you have a case is by consulting a Seattle personal injury lawyer. At Premier Law Group, we offer free initial consultations to injured people. Call 206-285-1743 today to schedule a free consultation.

What Can You Recover In Your Case?

The reality is, it’s impossible to know exactly what you can recover until you reach a certain point in your case. We can estimate the value of a personal injury case when your treatment is complete and we have a thorough understanding of the accident’s long-term consequences. Keep in mind that every case is different because every accident and everybody is different. How an event impacts you is different from how it impacts someone else, even if you both have the same injury, like a broken leg.

You may be eligible to receive compensation for any of the following damages:

  • Current and future medical bills related to your injury
  • Pain and suffering
  • Permanent injury or disability
  • Mental anguish and emotional trauma
  • Special equipment needed to accommodate your injury
  • Lost wages
  • Loss of earning capacity
  • Diminished earning capacity
  • Wrongful death
  • And more

Common Types Of Personal Injury Cases

The Seattle personal injury lawyers at Premier Law Group have extensive experience handling all of the following. Click the links to learn more about each.

Vehicle Accidents

  • Car Accidents: Car accidents are probably the most common type of personal injury case in Seattle. Accidents that involve distracted driving, drunk driving, reckless driving, defective car parts, and poor vehicle design may all qualify as personal injury cases. You may also have a personal injury case if you were a passenger or pedestrian in a road accident.
  • Bicycle Accidents: Seattle is a great city for cyclists. Unfortunately, they are often the victims of road accidents. Because cars are so much bigger and more powerful than bicycles, collisions between the two usually don’t end well for those riding bicycles. Accidents resulting from road disrepair or unsafe traffic patterns may also qualify for personal injury compensation.
  • Motorcycle Accidents: People driving motor vehicles like cars and trucks often fail to notice motorcyclists. The difference in size between a car or truck and a motorcycle means that motorcyclists typically suffer grave injuries. Even if the other driver did not see you, they are still responsible for your accident.
“I’ve engaged with Kristina Ohlinger as my point of contact at Premier Law Group for my case related to personal injury from an auto accident.  It’s been an excellent experience working with Kristina. She is experienced, knowledgeable, professional, responsive, and pleasant to work with. She consistently shows compassion for her clients and is passionate about her work! The entire team at Premier Law Group is fantastic.  Premier Law Group responded promptly and answers all of my questions.  I highly recommend Kristina and Premier Law Group as your legal representation!”Google review from R.A.

  • Truck Accidents: Seattle is a national trading port. This means there are a lot of tractor-trailers coming into and leaving the area. The size of tractor-trailers can make them a dangerous presence on the road. If you are injured in an accident with a tractor-trailer, you may be entitled to compensation by the driver, trucking company, or even vehicle manufacturer. These can be complex cases that require you to hire a Seattle personal injury lawyer.
  • Pedestrian Accidents: Pedestrians have the right of way over bicycles and motor vehicles. If you are struck and injured, the driver is often at fault for failing to “exercise due care” by texting, talking on a cell phone, speeding, or driving under the influence.

Hazardous Properties

Premises Liability Accidents: Situations involving a fire, chemical leak, porch or deck collapse, swimming pool accident, or insufficient security may warrant a personal injury claim. Hazardous property cases may also involve amusement park malfunctions, protruding nails, flooding, fallen tree limbs, escalator malfunctions, and other unsafe property conditions.

Slip and Falls: If unsafe property conditions such as ice-coated sidewalks or wet floors caused you to slip, fall, or trip and injure yourself you may deserve compensation. This is especially true if the property owner was aware of the hazard and did not attempt to fix it.

“I have been working with Aubrey since early June. So far she had been nothing but EXCEPTIONAL!!! Every time I have inquiries about my claim, she’s always been graciously proactive and very professional in dealing with all my concerns… Audrey goes above and beyond in her efforts to reach out to me. I’ve always felt comfortable knowing that she’s gonna advocate what’s best for her client. I am truly grateful for all that she has done so far. She’s definitely a GEM!!!”Oscar Estaris

Family Members Who May Need A Seattle Personal Injury Lawyer

Child Injuries: Injuries involving anyone under 18 years of age require that a parent or guardian file the personal injury claim in their name. Examples of child injury claims include any of the case types above. They also include medical negligence and improper or insufficient care at daycare or school. Injuries to children and minors often have long-lasting consequences and impact the entire family.

Wrongful Death: Wrongful death cases are situations where someone has died because of someone else’s negligence. There may be medical bills, funeral expenses, and a dramatic change in future income from lost wages. The right Seattle personal injury attorney can help you cover expenses and ease the financial stress in such a difficult time.

nursing home

Nursing Home Negligence And Abuse: Nursing home management and staff sometimes fail to implement or uphold clear standards. When this hurts a loved one, it may be grounds for a personal injury claim. Nursing homes should also have reliable policies and procedures to prevent abuse from happening. If a loved one was hurt or abused in a nursing home, a Seattle personal injury attorney may be able to help.

“Working with Jason and Danielle was great. They got the best settlement that I could have hoped and were always easy to communicate and work with. Jason is very straightforward and direct which is really fantastic to have on your side.” Jeff Holden

While I never would have to go through the injuries again, having gone through it they made the best process

Other Accidents

Dog Bites And Other Animal Attacks: In Seattle, pet owners are liable for injuries as well as property damage caused by their animals. Victims of animal attacks may face expensive medical bills, emotional trauma, and even permanent injury or disfigurement. Infections such as rabies and MRSA are an additional factor. Frighteningly, children are commonly victims of animal attacks.

Construction Site Injuries: Construction site injuries are surprisingly common. You may need help from a Seattle personal injury lawyer if you were injured while working on a construction site or if a loved one was killed on the job. This is a complicated area of the law.

“Excellent advice, friendly caring office, quick responses from everyone on the team, highly recommend.” –Robin Clark

The most important thing to do is to focus on your health. Attend all of your medical appointments and be sure to follow your doctor’s instructions to get as healthy as possible.

If possible, write down everything you can remember about your accident. This includes the circumstances leading up to your accident, the circumstances of the accident itself, and its aftermath. Continue writing about appointments and related experiences so you have a record of how the accident has affected your life.

You’ll also want to speak with a Seattle personal injury lawyer. With enough information, they’ll be able to say whether you have a case and what it may be worth. Premier Law Group offers free initial case evaluations for injured people. Part of our mission is to ensure that everyone who contacts us becomes more informed about their legal options – whether we represent them or not. Call 206.285.1743 to schedule a free consultation.

Frequently Asked Questions About Personal Injury in Seattle, WA

Should I accept a settlement offer from the insurance company?

When dealing with insurance companies, it is important to remember that they are not on your side. They will do everything in their power to offer you a low-ball settlement or even deny your claim. It is generally best not to accept the first offer until you have a thorough assessment of the damages that you have sustained. Before accepting a settlement offer from an insurance company, it is always best to consult with an experienced Seattle personal injury lawyer who can provide you guidance in navigating an offer from an insurance company.

What damages can I recover from a personal injury accident in Seattle, WA?

There are different categories of damages you can recover if you have been involved in a personal injury accident in Seattle. Typically, there are two categories of damages that an accident victim can recover: general damages and special damages. General damages are considered the non-economic impacts that result from a personal injury accident. These can include pain and suffering, loss of consortium or companionship (basically, the damage that occurs to one’s personal relationships as a result of the accident) as well as other negative impacts on the quality of life of a person that occurs as a result of the accident. It is difficult to assign a precise dollar value to general damages. However, general damages do have a legitimate and lasting impact on a person’s life so these should be taken into consideration as damages that a victim could seek to recover. Special damages refer to the economic damages of having sustained a personal injury. These include things like medical bills and lost wages and are generally easier to quantify. Since every case is unique and every person is different, the damages that you can recover from a personal injury accident in Seattle will be dependent on the extent of your injuries and the impact of these on the quality of your life. How long will it take for my personal injury claim to settle in Seattle, WA?

Every case is unique and the length of time it takes to resolve a case varies. Our Mission

Our mission at Premier Law Group is simple: provide the absolute best service to our clients, and make sure everyone who calls us ends up more informed about their options (whether or not we end up representing you!). It’s also important to the employment and personal injury attorneys at Premier Law Group to keep striving to be better than before; that’s why we make a point of staying in close contact with our clients throughout their case.

Our Goals

  1. Serving Our Clients with Compassion and Excellence

A car accident can put your whole life on pause. At Premier Law Group, we take every case personally because every case is personal to our clients. We understand that you not only want years of experience in car accident claims, but you also want attorneys who understand that you need to get your life back on track.

  2. Build Relationships Based on Trust

You deserve a legal team that cares about your future more than their bottom line. As your attorneys, we will offer advice based on what is best for you, even if that means not moving forward with your case.

  3. Respectful and Regular Communication

Other firms think of their clients as mere case numbers or settlements to be quickly shuffled aside. We are proud of the personal interest that our attorneys take in every case, whether it be a car accident or wrongful death. Keeping our clients regularly informed is an important part of the process for us and for our clients as they recover.

  4. Bringing You Results

Every case is different, and it’s impossible to guarantee any specific result. What we do guarantee is that we will apply our considerable experience and personal attention to your case to achieve the best possible outcome for you and your family.

  5. Making Legal Knowledge Accessible to Victims & Their Families

Years of experience helping victims of car accidents, pedestrian accidents and a myriad of other personal injury cases have made our attorneys passionate about helping all victims and their families. We know the tricks that insurance companies will pull and the way they take advantage of people just trying to recover. Not every case needs an attorney, but that doesn’t mean you need to go in blind. Premier Law Group partner Jason Epstein has written over a dozen books detailing how to handle various personal injury issues, which he offers to the public free of charge.

Our Commitments to You

  • Committed to Your Recovery

  • Committed to Communication

At other firms, you might wait weeks for a returned phone call or wonder if your attorney even knows your name. It can be easy for these firms to forget that their clients are people first and not just numbers. Our mission and promise that if you want to speak to an attorney, all you have to do is call the paralegal assigned to your case. They will transfer you right away, or, if the attorney is in court, set an appointment for you as soon as possible.

  • Committed to Excellence

We can organize a team of experienced attorneys from various practice areas to handle every aspect of your case no matter how complex. We know that the majority of work happens outside the courtroom, so we assign the best and most experienced paralegals to every case.

  • Committed to Your Case, All the Way to Trial

We are committed to victims of negligence, car accidents, motorcycle accidents, dog bites and wrongful death. Each of these practice areas require unique knowledge, and yet they are all the same in one vital way: they leave victims hurt, scared and alone.
